Legal Action to be Filed Today Regarding Public
Education.
On January 14, the Kentucky Student Voice Team filed KSVT v. Commonwealth of Kentucky in Franklin Circuit Court, essentially suing the state to enforce the provisions of the 1989 Council for Better Education v. Rose decision. This lawsuit has the potential to have major implications for Kentucky Public Education. KASA will monitor the case and keep our members informed of developments.
The Rose Decision led to the enactment of the KY Education Reform Act in 1990, establishing the rights to an adequate and equitable education for all Kentucky students. Kentucky saw measurable improvements in public education after the Rose Decision but after the Great Recession in 2008, we began to see a drop in commitment and support, culminating in where we are today with teacher shortages, declining funding in real dollars, and criticisms of public schools for low test scores.
KASA cannot be actively involved in this lawsuit unless at some point we decide to file an amicus brief. However, we want to make sure our members are aware of developments in this legal action, and we will post information and updates on our website in the advocacy section.
